Petition by Fulton Foundation (hereinafter referred to as the 'Foundation') and the executors of the estate of Samuel A. Fulton,
deceased, pursuant to the Wisconsin Administrative Procedure Act (ch. 227, Stats.) to review an order of the Wisconsin Board
of Tax Appeals (hereinafter referred to as the 'board'), which modified and affirmed an order of the Wisconsin Department
of Taxation (hereinafter referred to as the 'department'). The department's order had denied the applications of the petitioners
herein for the abatement of an assessment of gift tax. Fulton Foundation was incorporated December 23, 1948, as a non-stock, non-profit corporation under ch. 180, Stats.1947. The
three incorporators were Samuel A. Fulton and Luella M. Fulton, his wife, and James Toussaint, a friend and business associate
of Samuel Fulton. All were residents of the state of Wisconsin.
